Geidi Sile, Attorney-at-Law, represented a client at the Court of Justice of the European Union

The application for procedure of exequatur and supervision proceeding is the case before the Criminal Chamber of the Supreme Court. The latter turned to the Court of Justice of the European Union in order to inquire the way to exercise supervision of imprisonment adjudged in Latvia and supervising the conditional sentence failed to apply in Estonia. The court session took place on the 14th of November 2019, in Luxembourg.

The application of the principles of mutual recognition to judgements and probation decision between member states were discussed at the international scene. Among other issues, what will happen when convicted offender commits a new criminal offence while on probation in a state were the court judgement was made or when it takes place in the state that transposed the monitoring obligation were discussed at the session.

The ruling of the Court of Justice of the European Union shall be anticipated in 2020, the litigation will continue at the Supreme Court.
